Man gets probation for sex abuse charges
VICTORVILLE • A man was sentenced to three years of supervised probation following his conviction for sexual battery, stemming from his 2011 arrest for sexually abusing three children over an extended period of time.
Carlos Montoya took a plea deal in September, pleading no contest to a felony charge of sexual battery for the purpose of arousal, San Bernardino County court records show. He was sentenced to 364 days in jail but received credit for time served and was released from custody following Tuesday’s sentencing in Victorville Superior Court.
Montoya was arrested at a home in Phelan in December 2011 and charged with three counts of continuous sexual abuse of a child after one of three suspected victims reported the abuse to a teacher two months prior. An investigation led sheriff’s officials to two more suspected victims.
Montoya, 53, received three years of supervised probation with 45 conditions attached to his term, according to court records, including that he complete counseling and child abuse prevention programs, that he can’t contact the victims and must stay away from areas where children congregate.
